Please note that "Skiddaw View Holiday Park" and "Stay Lakeland" are brand names of "Skiddaw View Holiday Park Ltd" (the company) and arrange bookings of holiday accommodation as agents only on behalf of the owner so you enter into a contract with the owner of the property when we issue an email or written holiday 'booking confirmation' form. References to "we", "us" or "our" are references to Skiddaw View Holiday Park. Your use of us as a booking agent is at all times subject to these Terms and Conditions (which forms a legally binding contract between you and us) and all applicable laws. 

DEPOSIT PAYMENT AND CONFIRMATION OF BOOKING: Upon booking your holiday our agreement with you is a legal contract. When a booking is made a deposit payment is required before your booking is confirmed. If however your booking reservation is placed within 7 weeks of your holiday arrival date, payment must be made in full before confirming your holiday. Please note your holiday reservation is not confirmed until a confirmation is sent from Skiddaw View Holiday Park (either via email or written). We reserve the right to refuse any booking before we have issued the written holiday confirmation form.

Your booking is made as a consumer and you agree neither our company nor owner will accept liability for expenses, costs, losses, claims or other sums that relate to any business however so suffered or incurred by you. You must be over 18 years of age at the time of making your booking. 

As soon as you receive the written holiday confirmation form, you must check it carefully. Any errors or omissions must be reported to us immediately.

BALANCE PAYMENT: Balance payment must be made on the due date which will be outlined upon booking. Upon receipt of payment using a credit/debit card or by cheque (payable to "Skiddaw View Holiday Park Ltd") a confirmation letter or email will be sent to the hirer. Non payment of the final balance prior to the stated due by date will result in the cancellation of the holiday and forfeit of any deposits paid. 

CANCELLATION: 'Cancellation' means that the property will not be occupied by any members of your party.

CANCELLATION BY YOU: All cancellations must be made in writing, after this your cancellation will be confirmed by us along with a cancellation reference number. Please note cancellations are not confirmed until a valid cancellation reference number is issued by us. If your holiday is cancelled you will only be refunded the monies paid toward the holiday (excluding the deposit) if the property can be relet. We shall seek to relet the property at the best possible price but not necessarily at the advertised price. If successful, we will normally return the balance (calculated from the new booking - up to a maximum of the original agreed balance; less the deposit) to you within 14 days of the original departure date. If we are unsuccessful in re-letting the property NO monies will be refunded to you. Cancellation Insurance is highly recommended. This can obtained from many sources including: independent insurance brokers, websites, major supermarkets etc. Please note Skiddaw View Holiday Park does not endorse any specific cancellation insurance scheme. 

CANCELLATION BY US: In the unlikely event that your holiday becomes unavailable due to reasons beyond our control we will offer alternative accommodation of equal standard, if an equal standard property is unavailable you may be offered an alternative with a partial refund, covering the price discrepancy. In the event that there is no alternative accommodations available or you decline the offers to change accommodation you will be refunded ANY monies paid towards the holiday.

ARRIVAL AND DEPARTURE: Your accommodation will be ready for you from 4.00pm on the day of your arrival, unless otherwise agreed in advance. Please do not arrive earlier as your accommodation will not be ready. You should vacate your accommodation by 10am on the morning of your departure. To assist our cleaners, we ask that you leave the property in a clean and tidy condition.

OCCUPANCY: During your holiday the group size should not exceed the maximum number of people the property will sleep according to the details provided for each individual property. If the group size does exceed the maximum, you can be made to leave the property before the end of your holiday. If this does occur then your holiday will be treated as cancelled by you, and you will not be entitled to a refund of monies or compensation. We retain the right to gain access to any property at any time to complete any tasks which we consider necessary. If at anytime you wish to extend your holiday this must be done through our booking office; however we make no guarantee that the accommodation will be available for any period. 

CARE OF ACCOMMODATION: Our accommodations are all lovingly cared for and as a result we ask you to treat the accommodation with respect and leave it tidy. Any damages must be reported to our office prior to your departure in order for it to be fixed/replaced before the arrival of the next guests. We do however reserve the right to charge for any damage or breakages which we consider was deliberately or recklessly caused. You will be notified in writing as soon as is reasonably practice; if the damage is discovered after you depart. Note in most cases we do not normally charge for minor breakages (i.e. glassware, crockery, etc.) provided that they have been reported to us. We also reserve the right to charge further sums if we are unable to re-let the property as a consequence of the damage.

PETS: Where permitted pets must be declared at the time of booking, however no pets are allowed in bedrooms or on lounge furniture, and must not be left unattended in the accommodation. We reserve the right to charge a sum in the event of damage being caused, or additional cleaning being required. You will be notified in writing as soon as is reasonably practicable, if the damage is discovered after you depart.

COMPLAINTS: If upon arrival or anytime during you holiday you have any problems or difficulties with your accommodation we must be contacted immediately so that, if possible, appropriate action can be taken during you stay; our office can be contacted on 01697320919. No complaints will be considered after the completion of your holiday unless they were raised when they arose. While we will make every effort to attend to repairs to properties/furniture/equipment/facilities which may be faulty or fail during your holiday no guarantees will be given and no refunds will be granted should any breakdown occur which cannot be immediately rectified. 

CHARGING OF ELECTRIC VEHICLES: Charging of electric vehicles is strictly prohibited in all rental properties, where we suspect or have seen this occur, you can be made to leave the property before the end of your holiday. If this does occur then your holiday will be treated as cancelled by you, and you will not be entitled to a refund of monies or compensation.

LIABILITY: We do not accept liability for damage, loss or injury unless caused by proven negligent act or omission of ourselves, our employees or contractors, or agents of the same, whilst acting in the course of their employment. This includes loss or damage to vehicles and their contents, and to the personal possessions you bring with you. 

TERMINATION:  Skiddaw View Holiday Park reserve the right to forthwith terminate any letting in the event that the holiday maker or any part of the holiday makers party cause deliberate or negligent damage to the property being let, behaves in such a way to cause or constitute a nuisance to neighbours or have more people staying in the property that previously stated at the time of booking. In such cases the hirer shall remain liable for the cost of any damage or outstanding rental and shall not be entitled to a refund. 

REFUNDABLE SECURITY DEPOSITS: For some properties (see individual property details) we require a good housekeeping deposit, which is added to the cost of your holiday. This will be returned to you if your accommodation is left in satisfactory condition, within 14 days of your departure. In the event that your accommodation is left in a less than satisfactory condition your good housekeeping/security deposit will not be returned. 

PROPERTY INFORMATION: We endeavour to ensure the information we provide is correct, Skiddaw View Holiday Park cannot accept any responsibility for any inaccurate, incomplete or misleading information provided either orally or written about any property, its facilities, and or services except in cases of negligence. Skiddaw View Holiday Park and the holiday property owners always strive to maintain the very best facilities and services to you and changes may have occurred since the production of the website and any other printed material. 

FORCE MAJEURE: Compensation payments will not apply where we cannot fulfil our obligations to our owners or holiday makers due to circumstances beyond our control. This would mean any event we or the owners or the holiday makers cannot foresee with all due care and shall include but is not limited to: riots, war or threat of war, terrorist activity, civil strife, natural or nuclear disaster, industrial dispute, adverse weather conditions, fire epidemic or health risk or any other circumstances amounting to force majeure.
